1. The commission on coordination of work on anti-corruption in the Rostov region (further – the commission) is created for anti-corruption in the Rostov region and is the constant operating coordinating body at the Governor of the Rostov region.
2. In the activity the commission is guided by the Constitution of the Russian Federation, federal constitutional laws, federal laws, decrees and orders of the President of the Russian Federation, resolutions and orders of the Government of the Russian Federation, other legal acts of the Russian Federation, the Charter of the Rostov region, Regional laws, legal acts of the Governor of the Rostov region and the Government of the Rostov region and also the present Provision.
3. The commission carries out the activity in interaction with Management of the President of the Russian Federation concerning anti-corruption, with territorial authorities of federal executive authorities, public authorities of the Rostov region, local governments, public associations and the organizations.
4. The presidium of the commission considers the questions carried to its powers by Part 2 of Article 6 of the Regional law of 12.05.2009 No. 218-ZS "About Anti-corruption in the Rostov Region".
5. The main objectives of the commission are:
5.1. Ensuring execution of decisions of Russian President's Council for Countering Corruption and its presidium.
5.2. Preparation of offers on realization of public policy in the sphere of anti-corruption to the Governor of the Rostov region.
5.3. Ensuring coordination of activity of public authorities of the Rostov region and local governments on realization of public policy in the sphere of anti-corruption.
5.4. Ensuring coordinated actions of executive authorities of the Rostov region and local governments and also their interactions with territorial authorities of federal public authorities at implementation of measures for anti-corruption in the Rostov region.
5.5. Ensuring interaction of executive authorities of the Rostov region and local governments with citizens, institutes of civil society, mass media, the scientific organizations for anti-corruption in the Rostov region.
5.6. Informing the public on the Rostov region which is carried out by executive authorities and local governments to work on anti-corruption.
5.7. Participation in increase in legal culture of citizens and anti-corruption promotion.
6. The commission for performance of the tasks assigned to it carries out the following powers:
6.1. Prepares suggestions for improvement of the legislation of the Russian Federation on anti-corruption to the Governor of the Rostov region.
6.2. Develops measures against corruption and also on elimination of the reasons and conditions generating corruption.
6.3. Develops recommendations about the organization of anti-corruption education of citizens for formation of the intolerant relation to corruption and anti-corruption standards of behavior.
6.4. Will organize:
preparation of drafts of regulations of the Rostov region on anti-corruption;
development of the anti-corruption program of the Rostov region and development of the plans of measures on anti-corruption of executive authorities of the Rostov region and also control of their realization, including by monitoring of efficiency of implementation of measures for anti-corruption, provided by the program (plans).
6.5. Considers the questions concerning observance by the persons replacing the state positions, the restrictions and requirements established for anti-corruption.
6.6. Takes measures for identification (including on the basis of addresses of citizens, the information spread by mass media, protests, representations, instructions of federal public authorities) the reasons and conditions generating corruption, creating administrative barriers.
6.7. Renders assistance to development of public control over implementation of the anti-corruption program of the Rostov region, the plans of measures in anti-corruption of bodies of the executive Rostov region.
6.8. Carries out preparation of the annual report on activity in the field of anti-corruption, provides its placement on the official site of the Government of the Rostov region on the Internet, publication in mass media and the direction in federal public authorities (by their inquiries).
6.9. Carries out anti-corruption monitoring.
7. The commission is formed in structure: chairman of the commission, two of his deputies, secretary and members of the commission.
8. The chairman of the commission on a position is the Governor of the Rostov region or the person who is temporarily fulfilling his duties.
9. Deputy governors of the Rostov region, the minister of safety and anti-corruption in the Rostov region, heads of public authorities of the Rostov region, local governments, representatives of the office of the Russian President's Plenipotentiary in the South federal district, heads of territorial authorities of federal public authorities, the chairman of Public chamber of the Rostov region, representatives of the scientific and educational organizations, representatives of public organizations which authorized problems is participation in anti-corruption and also representatives of mass media can be a part of the Commission.
10. Delegation of power of the member of the commission to other person is not allowed.
11. Participation in work of the commission is carried out on a voluntary basis.
12. Representatives of federal public authorities, public authorities of the Rostov region, local governments, organizations and mass media can be invited to meetings of the commission.
13. According to the decision of the chairman of the commission for the analysis, study and preparation of the expert opinion on the questions considered by the commission experts can be involved in its work on a temporary or constant basis.
14. Work of the commission is carried out on a planned basis and according to regulations which are approved by the commission.
15. Meetings of the commission are conducted by the chairman of the commission or on his assignment one of vice-chairmen of the commission.
16. Meetings of the commission are held, as a rule, once in a quarter. In case of need at the initiative of the chairman of the commission, the vice-chairman of the commission and also the member of the commission (in coordination with the chairman of the commission or his deputy and for representation of the secretary of the commission) emergency meetings of the commission can be held.
17. Meetings of the commission are held openly (presence of the persons who are not members of the commission is allowed). For ensuring confidentiality by consideration of appropriate questions by the chairman of the commission or in his absence one of vice-chairmen of the commission to whom conducting a meeting of the commission is entrusted can make the decision on holding a private meeting of the commission (there are only members of the commission and persons invited to a meeting). The meeting of the commission is competent if at it there is more than a half from the numerical structure of the commission.
18. The decision of the commission is made out by the protocol which is signed by the chairman at a meeting of the commission and the secretary of the commission. Decisions of the commission are subject to consideration by the appropriate public authorities of the Rostov region, local governments and the organizations.
19. For implementation of decisions of the commission legal acts of the Governor of the Rostov region and the Government of the Rostov region can be issued and also to be given instructions of the Governor of the Rostov region.
20. According to the decision of the commission from among members of the commission or representatives authorized by them and also from among representatives of public authorities of the Rostov region, local governments, representatives of public organizations and experts the working groups on single questions can be created.
21. Chairman of the commission:
performs the general management of activity of the commission;
approves the plan of work of the commission (annual plan);
approves the agenda of a meeting of the commission;
gives instructions within the powers to members of the commission;
represents the commission in the relations with federal public authorities, public authorities of the Rostov region, the organizations and citizens on the questions which are within the competence of the commission.
22. Ensuring activity of the commission exercises control on anti-corruption at the Governor of the Rostov region (further – management).
23. Preparation of materials for meetings of the commission and control of execution of the decisions made by it exercises control.
Public authorities to which sphere of maintaining the questions included in the agenda of a meeting of the commission belong can take part in preparation of materials for meetings of the commission.
Necessary materials and the draft decision of the commission on cases in point are presented to the chairman of the commission not later than three working days prior to a meeting of the commission.
24. Secretary of the commission:
provides preparation of the draft of the plan of work of the commission (annual plan), forms the agenda of its meeting, coordinates work on preparation of necessary materials for a meeting of the commission, drafts of the relevant decisions, keeps the minutes of the commission;
informs the members of the commission invited to a meeting of persons, experts, other persons about the place, time of carrying out and the agenda of a meeting of the commission, provides them with necessary materials;
makes out minutes of meetings of the commission;
will organize performance of the instructions of the chairman of the commission given by results of meetings of the commission.
25. According to the decision of the chairman of the commission information on decisions of the commission (completely or) can be transferred to mass media for publication in any part.
