About a statement 
Regulations on public councils 
at executive authorities of the Rostov region

 

According to Part 2 of Article 221 of the Regional law of 06.07.2011 the No. 619-ZS "About Public Chamber of the Rostov Region" Government of the Rostov Region decides:

 

1. To approve the Provision on public councils at executive authorities of the Rostov region under the appendix.

2. To recognize the become invalid Decree of the Government of the Rostov region of 11.07.2013 No. 440 "About an Order of Formation of Public Councils at Executive Authorities of the Rostov Region" .

3. To impose control over the implementation of the resolution on the deputy governor of the Rostov region V.G. Goncharov.

SITUATION

about public councils

at executive authorities of the Rostov region

 

1. General provisions

 

1.1. Public councils at executive authorities of the Rostov region (further – public councils) are recognized to provide accounting of requirements and the interests of citizens of the Russian Federation, protection of the rights and freedoms of citizens of the Russian Federation and the rights of public associations at implementation of public policy in the part relating to a field of activity of executive authority of the Rostov region and also for implementation of public control over activity of appropriate authority of executive power of the Rostov region.

1.2. Public councils are permanent consultative advisory bodies of public control.

1.3. In the activity the public councils are guided by the Constitution of the Russian Federation, federal laws, other regulations of the Russian Federation, the Charter of the Rostov region, regional laws, other regulations of the Rostov region and also the present Provision.

 

2. Tasks, functions and rights of public councils

 

2.1. The main objectives of public councils are:

ensuring interaction of the organizations and citizens with executive authorities of the Rostov region;

accounting of socially significant legitimate interests of the organizations and citizens, protection of the rights and freedoms of the person and citizen at realization by executive authorities of the Rostov region of the powers.

2.2. The main functions of public councils are:

involvement of experts, representatives of public associations and other organizations, specialists in activities of executive authorities of the Rostov region, independent of public authorities, to assistance and participation in realization of their powers;

conducting public examination of drafts of regional laws, legal acts of the Governor of the Rostov region and the Government of the Rostov region developed by executive authorities of the Rostov region, drafts of legal acts and other decisions of the executive authorities of the Rostov region sent to public councils by appropriate authorities of executive power of the Rostov region;

introduction of suggestions for improvement of activity of executive authorities of the Rostov region;

implementation of public control over activity of executive authorities of the Rostov region;

participation in the organization and holding thematic actions, conferences, "round tables", seminars, discussions with involvement of public members, professional community;

participation in monitoring of quality of rendering public services by executive authority of the Rostov region;

participation in anti-corruption work, assessment of efficiency of government procurement and personnel work   in executive authorities of the Rostov region;

implementation of other functions for realization of the tasks assigned to public councils by the present Provision.

2.3. Public councils have the right:

to request and receive necessary documents and other data from appropriate authority of executive power of the Rostov region;

to invite representatives of federal executive authorities, executive authorities of the Rostov region, structural units of the Government of the Rostov region, local governments and the organizations to the meetings;

to send to appropriate authority of executive power of the Rostov region the conclusions and offers;

to form the working groups.

to take part in work:

commissions on observance of requirements to office behavior and settlement of conflicting interests;

other working bodies created by executive authorities of the Rostov region concerning personnel work, anti-corruption activity and purchases (goods, works, services) including placement of the state orders for performance of research works and rendering consulting services.

2.4. The representatives of public councils determined by legal acts of executive authorities with the consent of members of public councils join in the structures of contest and certifying commissions of executive authorities of the Rostov region.

 

3. Formation of public councils

 

3.1. Public councils are created by legal acts of executive authorities of the Rostov region according to the offer of Council of Public chamber of the Rostov region not later than in 30 calendar days from the date of receipt of the relevant proposal.

3.2. The number and staff of public councils are defined by legal acts of appropriate authorities of executive power of the Rostov region.

Total number of members of each of public councils should not be less than 5 and more than 15 people.

3.3. Members of public councils have to conform to the following requirements:

to have citizenship of the Russian Federation and age of 21 year;

to live in the territory of the Rostov region;

to have experience on a profile of activity of executive authority of the Rostov region at which the public council, of 1 year is formed;

not to have the conflict of interests connected with implementation of activity of the member of public council.

3.4. Cannot be members of public councils:

the persons recognized by court incapacitated or it is limited by capable;

the persons having not removed or unspent conviction;

the persons replacing the state positions of the Russian Federation, the state positions of the Rostov region, the state positions of other territorial subject of the Russian Federation, a position of the public civil service (public service of other look), positions of municipal service and also municipal positions;

representatives of public associations and other non-profit organizations which according to the Federal law of 25.07.2002 No. 114-FZ "About Counteraction of Extremist Activity" issued a warning in writing of inadmissibility of implementation of extremist activity, – within one year from the date of pronouncement of prevention if it was not recognized by court illegal;

representatives of public associations and other non-profit organizations which activity is suspended according to the Federal law of 25.07.2002 No. 114-FZ if the decision on stay was not recognized by court illegal.

3.5. The staff of public councils is approved by legal acts of appropriate authorities of executive power of the Rostov region, including taking into account offers of Council of Public chamber of the Rostov region, public associations and other organizations.

The candidacy of the member of Public chamber of the Rostov region proposed by Council of Public chamber of the Rostov region is subject to obligatory inclusion in the structure of public council.

3.6. Powers of the member of public council stop in a case:

submissions by it of the statement for secession of public council;

the introduction in validity of the conviction of court pronounced concerning it;

recognitions by its incapacitated, it is unknown absent or the dead on the basis of the judgment which took legal effect;

his death;

violations of the code of ethics of the member of public council, including systematic (3 and more) admissions of meetings of public council;

in the cases provided by Paragraph 5.6 of Section 5 of the present Provision.

 

4. Organization of activity of public councils

 

4.1. The chairman of public council, the vice-chairman of public council, the secretary of public council and other members of public council are a part of public council.

4.2. The chairman, the vice-chairman and the secretary of public council are elected by public council from the structure.

  Members of public council and the head of appropriate authority of executive power of the Rostov region have the right to put forward candidates for the chairman, the vice-chairman and the secretary of public council.

4.3. Chairman of public council:

performs management of its activity, presides over its meetings and represents public council in relationship with public authorities, local governments, the organizations and citizens;

signs minutes of meetings and other documents of public council;

forms with the assistance of members of public council and approves the plan of work for year, the agenda of a meeting and the list of the experts and other persons invited to a meeting of public council;

controls the timely notification of members of public council of date, time, the place and the agenda of the forthcoming meeting and also of the approved plan of work of public council;

makes proposals on documents of draft and other materials for discussion at meetings of public council and will coordinate them;

controls the timely direction to members of public council of minutes of meetings and other documents and materials;

makes proposals and coordinates structure of information on the activity of public council obligatory for placement on the official site of executive authority of the Rostov region    on the Internet;

interacts with the head of executive authority of the Rostov region concerning implementation of decisions of public council;

takes measures for prevention and/or settlement of conflicting interests at members of public council, including on the termination of a polnomochiychlen of the public council which is party of the conflict of interests.

4.4. Vice-chairman of public council:

at the request of the chairman of public council presides over meetings in its absence (in connection with a holiday, a disease, a business trip and other circumstances);

participates in preparation of the plan of work of public council for a year, formation of list of the experts and other persons invited to a meeting of public council;

provides collective discussion of the questions submitted for consideration of public council.

4.5. Secretary of public council:

notifies members of public council on date, time, the place  and the agenda of the forthcoming meeting and also on the approved plan of work of public council for year;

prepares and will agree with the chairman of public council on documents of draft and other materials for discussion at meetings of public council;

conducts, makes out, will coordinate with the chairman of public council and distributes to members of public council minutes of meetings both other documents and materials;

stores documentation of public council and prepares in accordance with the established procedure documents for archival storage and destruction;

prepares and coordinates with the chairman of public council structure of information on the activity of public council obligatory for placement on the official site of executive authority of the Rostov region    on the Internet.

4.6. Members of public council:

4.6.1. Have the right:

to make proposals on formation of the agenda of meetings of public council;

to head the commissions and the working groups formed by public council;

to propose candidacies of experts for participation in meetings of public council;

to participate in preparation of materials on cases in point;

to present the position on results of consideration of materials when holding a meeting of public council by poll in time no more than 10 days from the date of the direction to them of materials;

to get acquainted in accordance with the established procedure with the addresses of citizens including directed with use of the Internet about violation of their rights, freedoms and legitimate interests in the sphere of competence of appropriate authority of executive power of the Rostov region and also with results of consideration of such addresses;

to take part in the order determined by the head of executive authority of the Rostov region in the reception of citizens which is carried out by officials of executive authority of the Rostov region;

to request the reporting on implementation of the recommendations of public council submitted  in executive authority of the Rostov region;

to render to appropriate authority of executive power of the Rostov region at which  the public council, assistance in development of drafts of regulations and other legally significant documents is created;

it is free to leave public council at own will.

4.6.2. Have equal rights at discussion of questions and vote.

4.6.3. Are obliged to participate personally in meetings of public council and has no right to delegate the powers to other persons.

4.7. All members of public council participate in its activity on a voluntary basis.

4.8. In case of absence of the chairman of public council and (or) the vice-chairman of public council and (or) the secretary of public council of their duty the members of public council authorized by the chairman of public council, or, in case of impossibility of adoption of the relevant decision by it, elected public council from the structure execute.

4.9. Members of public council are obliged to observe the code of ethics of the member of public council which is approved by public council.

4.10. Meetings of public council are held at least once a quarter.

Meetings of public council are convened by its chairman on the initiative, according to the proposal of the head of appropriate authority of executive power of the Rostov region or on demand not less than half of members of public council.

4.11. The draft of the agenda of a meeting of public council is formed by the chairman of public council according to the proposal of members of public council and the head of appropriate authority of executive power of the Rostov region.

4.12. Members of public council are informed by the secretary of public council on date, time and the venue of a meeting in a written or oral form not later than 3 days about day of a meeting.

4.13. Consideration of questions and decision-making on them is allowed only at meetings of public council.

The order of holding meetings of public council is defined by its chairman.

The meeting of public council is considered competent if more than a half from the total number of his members participates in it.

The head of appropriate authority of executive power of the Rostov region or the official authorized by it participates in a meeting of public council with advisory capacity. Other employees of executive authority of the Rostov region have the right to be present at meetings of public council.

4.14. Decisions of public council are made by a majority vote from number of the members of public council participating in a meeting. In case of equality of votes the voice  of the public council presiding over a meeting is decisive.

4.15. Decisions of public council are enshrined in the minutes of public council which are signed by the secretary of public council and are approved presiding over a meeting of public council. The protocol has to be approved within 5 working days from the date of the meeting.

4.16. Are specified in the minutes of public council:

date, time and venue of a meeting of public council;

the approved agenda of a meeting of public council;

surnames, names, middle names and positions of the members of public council and other invited persons participating in a meeting;

the made decisions on the agenda of a meeting of public council.

4.17. Minutes of meetings of public council are stored in executive authority of the Rostov region within 5 years.

4.18. Minutes of meetings of public council or necessary extracts from them are sent within 5 working days from the date of the meeting of public council to the head of appropriate authority of executive power of the Rostov region.

4.19. Decisions of public council have advisory nature.

4.20. Organizational and technical and (or) information and analytical ensuring activity of public council carries out sootvetstvuyushchiyorgan executive power of the Rostov region within the approved budgetary appropriations provided on ensuring activity of this executive authority of the Rostov region according to the regional law on the regional budget.

 

5. Conflict of interests

 

5.1. The conflict of interests – a situation at which personal interest of the member of public council or influence (pressure) upon the member of public council influences or can influence appropriate execution of the powers by it and at which there arises or can be a contradiction between personal interest of the member of public council and legitimate interests of citizens of the Russian Federation, public associations, reference groups, capable to lead to infliction of harm to these legitimate interests.

5.2. Personal interest of the member of public council which influences or can influence objective implementation of the powers by it, is understood as a possibility of receiving income by the member of public council (superficial enrichment) in a monetary or natural form, income in a type of material benefit directly for the member of public council, members of his family or close relatives and also for citizens of the Russian Federation or public associations with whom the member of public council is connected by financial or other obligations.

5.3. Members of public council are obliged to inform annually till April 30 the chairman of public council and the head of executive authority of the Rostov region at whom the public council is created (in writing), on lack of the conflict of interests at them, and new members of public council – at their inclusion in the structure of public council.

5.4. In case of emergence at the member of public council of personal interest which brings or can lead to the conflict of interests or at emergence of a situation of rendering influence (pressure) upon the member of the public council connected with implementation of the powers by it the member of public council is obliged to inform on it in writing the chairman of public council as soon as possible.

5.5. In case of emergence at the chairman of public council of personal interest which brings or can lead to the conflict of interests or at emergence of a situation of rendering influence (pressure) upon the chairman of the public council connected with implementation of the powers by it the chairman of public council is obliged to inform on it in writing as soon as possible the head of executive authority of the Rostov region at whom the public council is created.

5.6. The chairman of public council or the head of executive authority of the Rostov region at whom the public council which it became known of emergence at the member of public council or the chairman of public council of personal interest which brings or can lead to the conflict of interests is created is obliged to take measures for prevention or settlement of conflicting interests, up to the termination of powers of the member of public council or the chairman of the public council which is party of the conflict of interests.
