bodies at the Government of the Rostov region

For improvement of work of coordinating and advisory bodies at the Government of the Rostov region, in pursuance of Rostovsko's chartery areas, the Regional law of 01.08.2011 the No. 635-ZS "About the Government of the Rostov Region" Government of the Rostov Region  decides:

1. To approve the Provision on coordinating and advisory bodies at the Government of the Rostov region under the appendix.

2. To impose control over the implementation of the present resolution on the deputy governor of the Rostov region V.V. Rudy.

SITUATION

about coordination and consultative

bodies at the Government of the Rostov region

1. General provisions

1.1. The present Provision defines an order of creation, activity and abolition of coordinating and advisory bodies at the Government of the Rostov region.

1.2. Coordinating and advisory bodies at the Government of the Rostov region are the collegial, interindustry bodies created for the solution of tasks of areas of jurisdiction of several executive authorities of the Rostov region.

 In the cases provided by regulations of the Russian Federation and the Rostov region for the solution of tasks within maintaining one executive authority of the Rostov region coordinating and advisory bodies at executive authority of the Rostov region are created.

Provision and the structure of coordinating and advisory bodies at executive authority of the Rostov region are approved by the act of executive authority of the Rostov region.

1.3. Coordinating and advisory bodies at the Government of the Rostov region are created in the form of the commissions, organizing committees, councils, headquarters and the working groups.

If according to the federal law, other regulatory legal act of the Russian Federation or the regional law the creation of coordinating or advisory bodies of interdepartmental character is necessary, they are formed as coordinating and advisory bodies at the Government of the Rostov region and are called according to the specified federal laws, other regulations of the Russian Federation or regional laws. The present Provision extends to the specified coordinating and advisory bodies in a part, unrepugnant to the relevant federal laws, other regulations of the Russian Federation or regional laws.

1.4. The commission at the Government of the Rostov region, the headquarters at the Government of the Rostov region – the permanent coordinating body at the Government of the Rostov region created for ensuring coordinated actions of executive authorities of the Rostov region on areas of jurisdiction of the Rostov region and also for ensuring interaction of the Governor of the Rostov region, the Government of the Rostov region, executive authorities of the Rostov region with territorial authorities of federal executive authorities, local governments of municipal units of the Rostov region, other bodies, public associations, the organizations.

Council at the Government of the Rostov region – the permanent advisory body at the Government of the Rostov region created for preliminary consideration of the questions referred to competence of the Government of the Rostov region and also for ensuring interaction of the Governor of the Rostov region, the Government of the Rostov region, executive authorities of the Rostov region  with territorial authorities of federal executive authorities, public authorities of the Rostov region, local governments of municipal units of the Rostov region, other bodies, public associations, the organizations.

Organizing committee at the Government of the Rostov region – the temporary coordinating body at the Government of the Rostov region formed for the organization of holding socially important actions (complex of actions) in the territory of the Rostov region.

The working group at the Government of the Rostov region – the temporary advisory body at the Government of the Rostov region created for preparation of the draft of the legal act, the contract (agreement) or the drafts of legal acts, contracts (agreements), development of concepts of development of the Rostov region connected among themselves in the socially important directions or for joint discussion of the question demanding immediate consideration and the decision.

1.5. Coordinating and advisory bodies at the Government of the Rostov region  in the activity are guided by the Constitution of the Russian Federation, international treaties of the Russian Federation, federal constitutional laws, federal laws, other regulations of the Russian Federation, the Charter of the Rostov region, regional laws, other regulations of the Rostov region, contracts, agreements of the Rostov region and the present Provision.

2. Creation order

2.1. Coordinating and advisory bodies at the Government of the Rostov region are created in the order established by Regulations of the Government of the Rostov region. Regulations on coordinating and advisory bodies at the Government of the Rostov region and their structures are approved by the Decree of the Government of the Rostov region.

2.2.   At the Government of the Rostov region have to be reflected in the Provision on coordinating and advisory body:

the name of coordinating and advisory body at the Government of the Rostov region;

tasks of coordinating and advisory body at the Government of the Rostov region;

the rights of coordinating and advisory body at the Government of the Rostov region;

order of holding meetings  and decision-making.

2.3. In case of creation of coordinating or advisory body at the Government of the Rostov region without the adoption of the Provision on it its structure is approved by the order of the Government of the Rostov region. At the same time the operating procedure of such coordinating or advisory body at the Government of the Rostov region is approved at its first meeting.

2.4. Drafts of Decrees of the Government of the Rostov region on the adoption of regulations on coordinating and advisory body at the Government of the Rostov region are subject to preparation and coordination according to Regulations of the Government of the Rostov region.

2.5. All coordinating and advisory bodies at the Government of the Rostov region join in the register of coordinating and advisory bodies at the Government of the Rostov region, the order of formation and which maintaining is approved by the Decree of the Government of the Rostov region.

2.6. Coordinating and advisory bodies at the Government of the Rostov region are formed on a representative basis. In the structure of coordinating and advisory bodies at the Government of the Rostov region  depending on questions for which solution they are formed, join representatives of appropriate authorities of executive power of the Rostov region, the structural units of the Government of the Rostov region, territorial authorities of federal executive authorities, local governments of municipal units of the Rostov region, other bodies, public associations (interested bodies and the organizations).

2.7. The structure of coordinating and advisory bodies at the Government of the Rostov region can be approved on the interested bodies to iorganization, on positions and (or) personally.

2.8.   Officials and the bodies possessing according to Regulations of the Government of the Rostov region the right of introduction of legal acts of the Rostov region can be initiators of creation of coordinating and advisory body at the Government of the Rostov region.

 In case of the approval of structure (part of structure) of coordinating or advisory body at the Government of the Rostov region on dolzhnostyamchlenam of coordinating or advisory body at the Government of the Rostov region the persons replacing in accordance with the established procedure (including it is temporary) the positions specified as a part of appropriate authority are considered.

 In case of the approval of structure (part of structure) of coordinating and advisory body at the Government of the Rostov region   their heads independently determine representatives of the interested bodies and the organizations by the interested bodies and the organizations what it is reported to the initiator of creation of coordinating and advisory body about. The head of the interested body or organization can replace one representative of the interested body or the organization with another, having notified on it the secretary of the appropriate coordinating or advisory body.

2.9.   The chairman (head), the vice-chairman (head), the secretary and other members of coordinating or advisory body at the Government of the Rostov region enter into the structure of coordinating and advisory body at the Government of the Rostov region.

2.10. At the Government of the Rostov region the Governor of the Rostov region, the Vice governor of the Rostov region, deputy governors of the Rostov region can be the chairman (head) of coordinating and advisory body.

   Several cochairmen, one of whom has to be the official specified in the paragraph the first the present point, can enter into the structure of coordinating and advisory body at the Government of the Rostov region. In this case powers of cochairmen of coordinating and advisory body at the Government of the Rostov region are distributed between them according to the Provision on coordinating and advisory body at the Government of the Rostov region.

 Several vice-chairmen (deputy heads) can enter into the structure of coordinating and advisory body at the Government of the Rostov region. In this case their powers are distributed between them the chairman (head) of coordinating or advisory body at the Government of the Rostov region.

 At the Government of the Rostov region, as a rule, the public civil servant of executive authority, structural unit of the Government of the Rostov region which is carrying out organizational and technical and (or) information and analytical ensuring activity of the appropriate coordinating or advisory body is approved as the secretary of coordinating and advisory body.

2.11. The Governor of the Rostov region, the Vice governor of the Rostov region, deputy governors of the Rostov region, heads of executive authorities, heads of strukturnykhpodrazdeleniye of the Government of the Rostov region, the public civil servants of executive authorities of the Rostov region and structural units of the Government of the Rostov region can be members of coordinating and advisory body at the Government of the Rostov region.

 Representatives of Legislative Assembly of the Rostov region, election commission of the Rostov region, the Commissioner for Human Rights in the Rostov region, territorial authorities of federal executive authorities, local governments of municipal units of the Rostov region, other bodies, public associations, the organizations can also be members of coordinating and advisory body at the Government of the Rostov region in coordination.

2.12. Members of coordinating and advisory bodies at the Government of the Rostov region take part in their activity as execution of the official or public duties if other is not provided by the Provision on coordinating and advisory bodies at the Government of the Rostov region.

3. Rights coordination and consultative

bodies  at the Government of the Rostov region

3.1. For the solution of the assigned tasks the coordinating and advisory bodies at the Government of the Rostov region have the right:

to request and receive  in accordance with the established procedure necessary documents and other data from federal executive authorities, executive authorities of the Rostov region, structural units of the Government of the Rostov region, bodies and officials of local government of municipal units of the Rostov region and the organizations;

to invite to the meetings representatives of federal executive authorities (in coordination with them), bodies of the executive vlastirostovsky area, structural units of the Government of the Rostov region, local governments of municipal units of the Rostov region and the organizations for the questions relating to an area of jurisdiction of coordinating or advisory body at the Government of the Rostov region;

to recruit in the activity ( with the consent of the corresponding head) the public civil servants of bodies of an ispolnitelnoyvlasta of the Rostov region, structural units of the Government of the Rostov region;

to make proposals on the questions requiring the solution of the Government of the Rostov region in the Government of the Rostov region;

to form the working groups.

3.2. Coordinating and advisory bodies at the Government of the Rostov region can have other rights according to provisions of it.

4. Bases of the organization

bodies  at the Government of the Rostov region

4.1. Consideration of questions and decision-making on them is allowed only at meetings of coordinating and advisory body at the Government of the Rostov region.

4.2. The order of holding meetings of coordinating and advisory bodies at the Government of the Rostov region is established by regulations on them.

4.3. The meeting of coordinating and advisory body at the Government of the Rostov region is considered competent if more than a half from the total number of his members participates in it.

4.4. Decisions of coordinating and advisory body at the Government of the Rostov region are accepted by a majority vote from number of the members of coordinating and advisory body at the Government of the Rostov region participating in a meeting of coordinating and advisory body at the Government of the Rostov region. In case of equality of votes the voice of the coordinating and advisory body presiding over a meeting at the Government of the Rostov region is decisive.

4.5. Decisions of coordinating or advisory body at the Government of the Rostov region are enshrined in the minutes of coordinating and advisory body at the Government of the Rostov region which are signed by the presiding over a meeting of coordinating ilisoveshchatelny body at the Government of the Rostov region and his secretary. The protocol has to be signed within 5 working days from the date of the meeting of coordinating and advisory body at the Government of the Rostov region.

4.6.   At the Government of the Rostov region are specified in the minutes of coordinating and advisory body:

date, time and the venue of a meeting of coordinating and advisory body at the Government of the Rostov region;

the approved agenda of a meeting of coordinating and advisory body at the Government of the Rostov region;

names and positions of the members of coordinating or advisory body participating in a meeting at the Government of the Rostov region  and other invited persons;

the made decisions on the agenda of a meeting of coordinating and advisory body at the Government of the Rostov region.

4.7. Minutes of meetings of coordinating and advisory bodies at the Government of the Rostov region are stored at the secretary of coordinating and advisory body at the Government of the Rostov region  not less than within 5 years.

4.8. Minutes of meetings of coordinating and advisory bodies at the Government of the Rostov region or necessary extracts from them sporucheniye of coordinating and advisory bodies at the Government of the Rostov region are sent secretaries of coordinating and advisory bodies at the Government of the Rostov region  within 5 working days from the date of the meeting of coordinating and advisory body at the Government of the Rostov region to the officials responsible for execution of orders of coordinating and advisory bodies at the Government of the Rostov region.

4.9. Organizational and technical and (or) information and analytical ensuring activity of coordinating and advisory bodies at the Government of the Rostov region is carried out by the structural units of the Government of the Rostov region, executive authorities of the Rostov region defined in the Provision on the appropriate coordinating or advisory body at the Government of the Rostov region or in the Provision on the relevant structural unit of the Government of the Rostov region, the Provision on executive authority of the Rostov region.

5. Abolition order

coordination and consultative

bodies at the Government of the Rostov region

5.1. Coordinating and advisory bodies at the Government of the Rostov region are abolished by the same by the form act of the Government of the Rostov region by which they were created.

5.2. Heads of coordinating and advisory bodies at the Government of the Rostov region take personal responsibility for timely modification of the structure of coordinating and advisory bodies at the Government of the Rostov region and also for timely abolition of coordinating and advisory bodies at the Government of the Rostov region.
