STANDARD SITUATION

about the counter-narcotics commission in the municipal unit

Rostov region

 

I. General provisions

1.1.       The counter-narcotics commission in the municipal unit of the Rostov region (further – the Commission) is the permanent collegial, interindustry body created for ensuring coordinated actions of local governments of the municipal unit and the organizations subordinated to them and also their interaction with territorial authorities of federal executive authorities (divisions of territorial authorities of federal executive authorities across the Rostov region in municipal units), executive authorities, other bodies and the organizations, public and religious associations (further – the interested bodies and the organizations) concerning realization of the public counter-narcotics policy in the territory of the municipal unit.

1.2.       The commission in the activity is guided by the Constitution of the Russian Federation, international treaties of the Russian Federation, federal constitutional laws, federal laws, acts of the President of the Russian Federation and the Government of the Russian Federation, other regulations of the Russian Federation, laws and regulations of the Rostov region, municipal legal acts and also decisions of the State Anti-Drug Committee and counter-narcotics commission of the Rostov region, the present Provision.

1.3.       Activity of the Commission is based on the principles of legality, democratism, support and protection of interests of citizens in providing their rights and freedoms, interactions with institutes of civil society and citizens, mass media; priority of preventive measures, their complexity and systemacity.

1.4.       The commission carries out the activity in interaction with the counter-narcotics commission of the Rostov region.

 

II. Tasks of the Commission

2.1.       The main objective of the Commission is providing in the territory of the municipal unit of carrying out the systematized coordinated activity of the interested bodies and the organizations directed to reduction of illicit trafficking and availability of drugs to consumption without medical prescription, minimization of negative consequences of such consumption, formation in the society of values of a healthy and safe way of life, intolerance to participation in drug trafficking.

In the activity the Commission is guided by the goal-setting approved by the Strategy of the public counter-narcotics policy of the Russian Federation until 2030.

2.2.       For the solution of the assigned tasks the Commission on competence of the activity:

a)  carries out monitoring and assessment of development of a drug abuse situation in the municipal unit with use of statistical, information and analytical data and expert estimates, results of social researches; develops and realizes suggestions for improvement of a drug abuse situation in the municipal unit and the Rostov region;

b)  participates in formation and realization in the territory of the municipal unit of the public counter-narcotics policy, including:

in development and implementation of regulations, state programs of the Russian Federation and the Rostov region, other documents of strategic planning;

in implementation of decisions of the State Anti-Drug Committee and counter-narcotics commission of the Rostov region;

c)  provides the coordinated activity of the interested bodies and the organizations, including approves interdepartmental documents (programs, orders of interaction, contracts, agreements) in the most relevant areas of work; will organize interdepartmental exchange of information;

d)   develops and realizes measures in the sphere of counteraction to drug trafficking, psychotropic substances and their precursors (reduction of the offer of drugs), prevention of not medical consumption of drugs and psychotropic substances (reduction of illegal demand for drugs) and also assistance to treatment, complex rehabilitation and resocialization of drug users and members of their families, including:

participates in development, realization, ensuring effectiveness and efficiency of complexes of counter-narcotics actions, plans, municipal programs / subprogrammes;

participates in carrying out at the municipal level of the interdepartmental events of counter-narcotics orientation held by federal executive authorities, public authorities of the Rostov region, local governments of the municipal unit;

renders assistance in development of infrastructure, forms and methods of counter-narcotics work, distribution of best practices of work;

e)  takes measures for protection of the rights and legitimate interests of the persons which are in socially dangerous situation, a difficult life situation needing social protection in connection with consequences of consumption of drugs or psychotropic substances, commission of offenses, crimes in the sphere of drug trafficking;

g)  provides information maintenance of the activity, participates in advocacy concerning realization of the public counter-narcotics policy in the municipal unit;

h)   carries out the analysis of efficiency of activity of the interested bodies and the organizations, takes measures for improvement of their activity;

i)  will organize cooperation with local governments, collegial and coordinating bodies of other municipal units of the Rostov region;

j)  approves the annual plan of the work, provides its realization and also exercises control of execution of decisions of the Commission, decisions of the counter-narcotics commission of the Rostov region;

k)  takes part in the solution of other tasks, according to the federal and regional legislation.

 

III. Rights of the Commission

3.1.       For the solution of the assigned tasks the Commission has the right:

a)  to request and receive in accordance with the established procedure necessary documents and other data from federal and regional executive authorities, local governments of the municipal unit, their structural units and officials, the organizations;

b)  to invite to the meetings, to hear representatives of federal and regional executive authorities (in coordination with them), local governments of the municipal unit and their structural units, other interested bodies and the organizations, citizens for the questions relating to an area of jurisdiction of the Commission;

c)  to recruit in the activity (with the consent of the corresponding head) local government officers, structural units of local governments of the municipal unit;

d)  to bring in the counter-narcotics commission of the Rostov region, appropriate authorities and local government of the offer on work improvement and also the offers requiring their solutions;

e)  to create the working groups;

e)  to make to the head of administration of the municipal unit proposals on change of staff of the commission.

 

IV. Creation order, list and duties of members of the commission.

4.1.       The commission is created at administrations of urban districts, municipal districts of the Rostov region.

4.2.     The commission is created in the order established by the municipal legal acts regulating activity of collegial, coordinating and advisory bodies in the municipal unit.

4.3.     The provision on the Commission and its structure, other documents regulating activity of the Commission are approved by the resolution of administration of the municipal unit.

4.4.     The chairman, vice-chairmen, the secretary and other members of the commission are a part of the Commission.

4.5.     The chairman of the Commission on a position is the head of administration of the municipal unit.

4.6.     Vice-chairmen of the Commission are the chief of territorial authority of internal affairs of the Ministry of Internal Affairs of the Russian Federation, the deputy head of administration of the municipal unit.

4.7.     The local government officer of structural unit of administration of the municipal unit which is carrying out organizational maintenance of activity of the Commission is appointed the secretary of the Commission.

4.8.     Members of the commission are representatives of the interested bodies and the organizations: heads and officials of local governments of the municipal unit, their structural units, heads of the organizations subordinated to them, divisions of executive authorities, territorial authorities of federal executive authorities (in coordination), other bodies and the organizations, public associations.

4.9.       Chairman of the Commission:

a)  performs management of activity of the Commission;

b)  approves the agenda of a meeting of the Commission (list, terms and an order of consideration of questions);

c)  conducts meetings of the Commission; will organize vote on decision-making of the Commission; signs minutes of meetings of the Commission;

d)  gives instructions to members of the commission on the questions referred to its competence;

e)  makes the decisions connected with activity of the Commission;

e)  controls execution of plans of work, decisions of the Commission;

g) provides submission of the established reporting on activity of the Commission;

h)   represents the Commission in relationship with territorial authorities of federal executive authorities, executive authorities, local governments of municipal units, public associations and the organizations and also mass media, on the questions referred to competence of the Commission;

i)   takes personal responsibility for the organization of work of the Commission and submission of the reporting on its activity.

4.10.   Vice-chairman of the Commission:

a)  fulfills duties of the chairman of the Commission in case of his absence;

b)  participates in formation of the agenda of meetings, in preparation and holding meetings, preparation of drafts of plans of work of the Commission, decisions of the Commission, organization of their execution;

c)  in the absence of the chairman of the Commission or on his assignment conducts meetings of the Commission, signs minutes of meetings of the Commission;

d)  executes instructions and decisions of the chairman of the Commission on issues of its activity;

e)  participates performed by decisions of the Commission regarding the competence;

e)   at the request of the chairman represents the Commission in relationship with territorial authorities of federal executive authorities, executive authorities, local governments of municipal units, public associations and the organizations and also mass media on the questions referred to its competence.

4.11.       Member of the commission:

a)   makes proposals in the plan of work of the Commission, initiates consideration at meetings of the Commission of the problematic issues connected with realization of the public counter-narcotics policy on an area of jurisdiction of the body/organization;

b)   will organize preparation of the questions submitted for consideration of the Commission according to plans of meetings of the Commission; takes personal responsibility for quality and timeliness of representation of materials;

c)   makes proposals on a transfer/exception of consideration of a question, on inquiry of additional materials on it;

d)   participates in meetings of the Commission; previously (prior to a meeting of the Commission) gets acquainted with materials on the questions submitted for its consideration; participates in discussion of the decisions made by the Commission on cases in point and votes at their acceptance;

e)   will organize implementation of decisions of the Commission within the powers of office;

e)   carries out orders of the chairman of the Commission;

g)  makes suggestions for improvement of work of the Commission;

h)    visits in the territory of the municipal unit of the organization and institution, participating in realization of the public counter-narcotics policy; holds meetings with citizens, including with being in socially dangerous situation, a difficult life situation, needing social protection in connection with consequences of consumption of drugs or psychotropic substances, commission of offenses, crimes in the sphere of drug trafficking.

4.12.   Secretary of the Commission:

a)   forms drafts of plans of work of the Commission, prepares reports on results of activity of the Commission;

b)   provides preparation and holding meetings of the Commission; including – forms drafts of decisions of the Commission; informs members of the commission and invited about the place, time of carrying out and the agenda of the regular meeting of the Commission; sends necessary materials to members of the commission;

c)   keeps the minutes of the Commission, makes out it for signing by the chairman of the Commission, provides the direction of the protocol to members of the commission;

d)   provides control of execution of the instructions which are contained in decisions of the Commission;

e)   provides control of performance of municipal legal acts, normative legal documents of the local governments connected with activity of the Commission;

e)   provides preparation of inquiries, drafts of the decisions and other documents and materials concerning performance of tasks of the Commission;

g)  will organize work on collecting, accumulation, generalization and the analysis of information within monitoring of a drug abuse situation in the territory of the municipal unit, development of suggestions for improvement of a drug abuse situation;

h)    provides interaction of the Commission with the counter-narcotics commission of the Rostov region and its device; will organize control of execution of decisions by the counter-narcotics commission of the Rostov region regarding competence of the Commission;

i)   provides activity of the working groups, other working bodies of the Commission;

j)   conducts office-work of the Commission.

 

V. Organizational bases of activity of the Commission.

5.1.       The commission carries out the activity according to the plan of work which is taken over at a final meeting of the Commission the next calendar year.

5.2.       Meetings of the Commission are held at least once a quarter.

In case of need, according to the decision of the chairman of the Commission, and in his absence – the vice-chairman, emergency meetings of the Commission can be held.

5.3.       Meetings of the Commission are considered as competent if at them there is not less than a half of its structure.

5.4.       Presence at a meeting of the chairman of the Commission, other members of the commission surely.

At impossibility of participation in a meeting the members of the commission inform on it the chairman of the Commission with the indication of the reason of absence (business trip, a disease, an extraordinary holiday).

In case of absence of the member of the commission at a meeting, he has the right to state the opinion on cases in point and the decision in writing.

The person fulfilling duties of the official who is the member of the commission after coordination with the chairman of the Commission can participate in a meeting of the Commission with advisory capacity.

5.5.       Members of the commission have equal rights by consideration and discussion of the questions referred to competence of the Commission, decision-making.

In case of disagreement with the made decision the member of the commission has the right to state in writing dissenting opinion which is subject to obligatory attaching to the protocol.

5.6.       The materials prepared for consideration at meetings of the Commission are provided to the chairman of the Commission and members of the commission for familiarity and coordination.

These materials, if necessary, pass the examination, are improved performers and are made out properly.

5.7.       The commission can consider single questions at a private meeting. Single questions can be considered at meetings together with other collegial and coordinating bodies at administration of the municipal unit.

5.8.       Decisions of the Commission are made by a simple majority vote the members of the commission who are present at a meeting and made out by the protocol which is signed by the chairman of the Commission and the secretary.

In case of equality of votes, the voice of the chairman of the Commission (the vice-chairman conducting a meeting on its assignment) is decisive.

5.9.       For implementation of decisions of the Commission drafts of municipal legal acts which are submitted for consideration to the interested members of the commission in accordance with the established procedure can be prepared.

5.10.   For organizational support of activity of the Commission the administration of the municipal unit defines structural unit (office of the Commission); designates the official (chief of staff of the Commission) responsible for the organization of this work and also the secretary of the Commission.

The chief of staff of the Commission can be appointed also the secretary of the Commission.

Other structural units of administration of the municipal unit, according to the functions can take part in organizational support of activity of the Commission, except the office of the Commission, in addition (material, information and analytical ensuring work of administration, control and so forth).

5.11.   Powers of the office of the Commission, the chief of staff of the Commission, the secretary of the Commission, other structural units for organizational support of activity of the Commission are defined by the regulatory legal act of administration of the municipal unit with the regulating documents, the present Provision.

5.12.   On organizational support of the Commission treat functions:

organization of scheduling of the Commission;

organization of holding meetings and other planned actions of the Commission;

control of timeliness of preparation and representation of materials for consideration at meetings of the Commission;

organization of record keeping of the Commission;

holding meetings, participation in the organization of interdepartmental actions;

implementation of collecting, processing and synthesis of information necessary for the solution of the tasks facing the Commission;

preparation of information and analytical materials concerning activity of the Commission;

organization of control of execution of decisions of the Commission: carrying out collecting, generalization and analysis of information on execution of orders of the Commission, assessment of their efficiency;

coordination of activity of the working groups of the Commission;

carrying out the analysis of efficiency of activity of the interested bodies and the organizations participating in realization of the public counter-narcotics policy in the territory of the municipal unit;

implementation of interaction with federal and regional public authorities, local governments, public and other associations, the organizations, mass media for the solution of the tasks facing the Commission;

organization of consideration of incoming requests of citizens for the questions which are within the competence of the Commission;

preparation of municipal legal acts, regulations on activity of the Commission;

organization of preparation and implementation of municipal counter-narcotics programs / subprogrammes, plans of work;

preparation and placement on the official site of administration of the municipal unit, in mass media about activity of the Commission;

other functions determined by the federal and regional legislation, documents regulating activity of administration of the municipal unit, the Commission.

5.13.   The interested bodies and the organizations which heads and officials are members of the commission take part in information and analytical ensuring activity of the Commission.

5.14.   For establishment of the general rules of the organization of activity of the Commission in addition to the present Provision the Regulations of the Commission providing an order of preparation and holding meetings of the Commission, an order of preparation and the approval of plans of work of the Commission, the requirement to execution of the decisions made at meetings of the Commission, to record keeping, etc. can be developed and approved.
